Please read these Terms and Conditions carefully before using the Improve English mobile application operated by Humanising Technology Pty Ltd ("we", "us", "our"). By creating an account and using the App, you agree to be bound by these terms.
1. Acceptance of terms
By downloading, installing, or using Improve English (the "App"), you confirm that you are at least 13 years of age (or the applicable minimum age in your jurisdiction), that you have read and understood these Terms, and that you agree to be bound by them. If you do not agree, please do not use the App.
2. Description of the service
Improve English provides AI-powered spoken English practice and coaching. The App uses real-time voice processing powered by OpenAI's GPT Realtime API to deliver feedback on grammar, vocabulary, and pronunciation. The service is intended for personal, non-commercial use as a language learning aid.
The App is not a substitute for professional language instruction, certified language assessment, or qualified human tutoring. Feedback is provided as coaching guidance only.
3. Account registration
You must create an account to use the App. You agree to:
- Provide accurate and complete registration information.
- Keep your login credentials confidential.
- Notify us immediately if you suspect unauthorised access to your account.
- Take responsibility for all activity that occurs under your account.
We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.
4. Acceptable use
You agree to use the App only for lawful purposes and in accordance with these Terms. You must not:
- Use the App to transmit, generate, or store content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
- Attempt to elicit responses from the AI coach that are outside its intended coaching scope (language learning feedback).
- Reverse engineer, decompile, or disassemble any part of the App.
- Use automated scripts or bots to interact with the App.
- Attempt to circumvent security measures or access systems beyond your authorised scope.
- Use the App in any way that could damage, disable, or impair our infrastructure or that of our service providers.
5. Microphone and permissions
The App requires access to your device's microphone to function. By granting microphone permission, you consent to the capture and real-time transmission of your voice to OpenAI's servers for processing. You may revoke microphone access through your device settings at any time, which will prevent you from using voice practice features.
6. AI-generated content
Coaching feedback is generated by AI and may occasionally contain errors, inaccuracies, or inappropriate suggestions. We do not guarantee the accuracy, completeness, or suitability of any AI-generated feedback for your specific learning needs. You are responsible for evaluating the feedback you receive.
The AI coach is designed to assist with English language learning only. We use technical and policy measures to limit responses to this scope, but we cannot guarantee the AI will never produce unexpected output.
7. Intellectual property
All content, software, design elements, and trademarks in the App are owned by Humanising Technology Pty Ltd or its licensors. You are granted a limited, non-exclusive, non-transferable licence to use the App for personal language learning purposes. Nothing in these Terms transfers any ownership rights to you.
Content you generate (your voice, text transcripts of your speech) remains yours. By using the App, you grant us a limited licence to process and store that content as necessary to provide the service, as described in our Privacy Policy.
8. Privacy
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read it carefully to understand how we handle your personal data.
9. Third-party services
The App integrates third-party services including OpenAI (voice processing) and Supabase (authentication and storage). Your use of these services through the App is also subject to their respective terms and policies. We are not responsible for the practices of these third parties.
10. Availability and changes
We aim to keep the App available at all times but do not guarantee uninterrupted access. We may modify, suspend, or discontinue the App (or any part of it) at any time, with or without notice. We may also update these Terms — continued use of the App after changes constitutes acceptance of the updated Terms.
11. Disclaimer of warranties
The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be error-free or that defects will be corrected.
12. Limitation of liability
To the maximum extent permitted by applicable law, Humanising Technology Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, loss of profits, or loss of goodwill — arising from your use of or inability to use the App, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or related to these Terms or the App shall not exceed the amount you paid us (if any) in the twelve months preceding the claim.
13. Governing law
These Terms are governed by the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of New South Wales for any disputes arising under these Terms.
